We respect the rights of creators and rights holders, and we expect people who use QtecX to do the same. This policy explains how to tell us about content on QtecX that infringes your copyright or trademark, what we do, and how the person who posted it can respond. It covers notices under the US Digital Millennium Copyright Act (DMCA) and the EU Digital Services Act.
In short
- Send a notice to hello@qtecx.si with the subject "Copyright" (or "Trademark").
- Tell us what work is infringed, where the content is, and how to reach you, and confirm you are the rights holder or allowed to act for them.
- We remove or disable the content quickly and tell the person who posted it.
- They can send a counter-notice if they believe it was a mistake.
- We close the accounts of repeat infringers.
Where to send a notice
Designated agent: QtecX Email: hello@qtecx.si (subject "Copyright" or "Trademark") Postal address: available on request at hello@qtecx.si
You can also use the "Report" button where it is shown and choose "Copyright".
What a notice must contain
To act quickly, we need:
- your signature (a typed full name is enough in an email);
- a description of the copyrighted work (or trademark) you say is infringed; for many works, a representative list;
- where the content is on QtecX: the exact link (URL), handle, project or hosted site, with enough detail for us to find it;
- your contact details: name, postal address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law;
- a statement that the information in the notice is accurate, and, under penalty of perjury, that you are the rights holder or authorised to act on their behalf.
Notices about content made with AI are welcome: tell us which of your works you believe the output copies or closely imitates.
Please do not send a notice for content you are allowed to use, for example under a licence, fair use, fair dealing or another exception. Under US law, someone who knowingly misrepresents that content infringes may be liable for damages.
What we do
- We confirm receipt and review the notice promptly.
- If the notice is complete and the claim is plausible, we remove or disable the content, or take the hosted site or part of it offline.
- We tell the person who posted it, with a copy or summary of the notice and a statement of reasons, and explain how to respond. We may share your name and the content of your notice with them; tell us if there is a safety reason not to.
- If the notice is incomplete, we tell you what is missing.
Counter-notice
If your content was removed and you believe it was a mistake or that you have the right to use it, you can send a counter-notice to the same address. It must contain:
- your signature (a typed full name is enough);
- a description of the content that was removed and where it was before removal;
- a statement, under penalty of perjury, that you believe in good faith that the content was removed or disabled as a result of a mistake or misidentification;
- your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the courts for your address (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the notice or their agent.
We send the counter-notice to the person who sent the original notice. Unless they tell us within 10 to 14 working days that they have filed a court action, we may restore the content. Outside the DMCA process, you can also appeal any of our decisions as the Acceptable Use Policy explains.
Repeat infringers
We close the accounts of people who repeatedly infringe other people's rights. A valid notice counts as a strike; a strike that is withdrawn or successfully countered is removed. Three strikes, or one serious case, normally lead to closing the account.
Trademarks and other rights
For trademarks, tell us the mark, the country where it is registered and the registration number, where the content is, and why it confuses people or misuses the mark. For other rights (for example personality or likeness rights), use the "Report" route in the Acceptable Use Policy.
