Terms of Service
These Terms of Service ("Terms") are the agreement between you and QtecX ("QtecX", "we" or "us") for your use of the QtecX platform, its desktop app and other apps, its websites and the sites hosted on it (together, the "service"). By creating an account or using QtecX, you agree to these Terms and to the policies they link to: the Privacy Policy, the Acceptable Use Policy, the AI and Generated Content Terms, the Refund Policy, the Cookie Policy, the Copyright and Takedown Policy and the Age Policy. You accept these Terms and the Privacy Policy by ticking the box when you sign up, or when we ask you to accept a new version. If you do not agree, please do not use QtecX.
In short
- Your contract is with QtecX, the company that provides the service.
- You must be 13 or older; under 18 you need a parent's or guardian's permission. Payments are for people 18 or older.
- Paddle.com is the Merchant of Record for all our orders: it takes the payment, charges the tax and issues the invoice.
- You own your content and what the agent makes for you. You are responsible for your prompts and for what you publish. Check the agent's work before you rely on it.
- Our systems automatically check every session and its outputs for safety, security and quality; this is always on. A person looks at your content only under fixed rules, and every look is logged.
- We use data to improve QtecX and to train our own models, with secrets and personal details removed first and never private work. You can turn this off in Settings › Data at any time.
- In the desktop app the agent works on your own computer, only where you allow it. You decide what it may touch, and what it does in apps you connect.
- Credits have no cash value. You can ask for a refund within 14 days of a purchase; see the Refund Policy.
- We tell you about a material change at least 30 days before it takes effect.
What changed in version 2.0: QtecX, the company, is the party you contract with; the automated checks of every session and its outputs and when a person may look at your content; what the model-improvement setting covers; learning from your corrections; using your own key with an AI provider; apps and tool servers you connect; what members of a shared project can see and do; the agent's actions in outside services. Because these changes are important, every account is asked to accept version 2.0; for accounts created before 2026-10-28, it applies from 2026-11-27. Version 1.4 described the desktop app and the encrypted code backup; version 1.3 named Paddle.com as our reseller and Merchant of Record and added the 14-day refund window and the policies on AI and generated content, copyright and takedown, age, data requests and sub-processors. Earlier versions stay available (see "Changes to these Terms").
1. Who we are
QtecX is an AI agent platform, available at https://qtecx.si. With QtecX you build software, websites, games, documents, designs and media together with an AI agent. In the desktop app, the agent writes, runs and tests your work on your own computer, in the folders you allow. On the web, QtecX works as chat, research and documents; cloud computers, where we offer them, give a project its own computer on our servers. You can work alone or with other people in shared projects, sessions and team spaces, and you can host what you build.
Where we say "we", "us" or "QtecX", we mean QtecX, the company that provides the service, reachable at the contact details below. Where we say "you", we mean the person using the service.
- Legal and privacy contact: hello@qtecx.si
- Help with your account: support@qtecx.si
- Postal address: available on request at hello@qtecx.si
2. Your account
2.1 Who can sign up
You must be 13 years old or older to use QtecX. If you are under 18 (or under the age of majority where you live), you may use QtecX only with the permission of a parent or legal guardian, who accepts these Terms for you and is responsible for your use. If the law where you live sets a higher minimum age for a service like QtecX, that age applies. Payments, paid plans and credit packs are only for people 18 years old or older. The Age Policy explains the details.
If you use QtecX for an organisation, you confirm that you may accept these Terms for it, and "you" then also means that organisation. Give us true and current details when you sign up, and keep them up to date.
2.2 Keeping your account safe
- Keep your password safe and turn on 2-step sign-in in Settings.
- One account is for one person. Shared projects and team spaces exist so people can work together, each with their own account.
- You are responsible for what happens in your account, including what the agent does on your request. If you think someone else has used it, change your password and write to support@qtecx.si at once.
Your handle is unique across the platform. We may reclaim or change a handle that impersonates another person, brand or organisation, or that breaks the Acceptable Use Policy.
2.3 Accounts in review and invite codes
When you sign up, your account may wait in review until we have room. We may decline a sign-up. While your account waits, you cannot use the service yet. A valid invite code opens your account at once. Invite codes are personal: do not sell or publish them.
3. The service
QtecX is a young service. We do our best to keep it running, but there is no uptime promise and no service level agreement unless we sign one with you in writing. Features change often, and we may add, change or remove features. In rare cases data may need to be reset; we will try to warn you first. Please keep your own copies of important work.
QtecX, its software, its design and its brand belong to us and our licensors. These Terms give you the right to use the service; they do not give you any ownership of it, or the right to use our name or logo without our written permission.
4. Using QtecX
You may use QtecX for lawful purposes and within these Terms, the Acceptable Use Policy and the AI and Generated Content Terms. In particular you must not:
- use the service to break the law, to commit fraud, to send spam, or to harm people or the service;
- infringe other people's intellectual property or privacy;
- spread malware, probe or attack systems, try to reach other people's data or computers, break the isolation of a cloud computer, or get around limits, credits, safety checks, the desktop app's permissions or other controls;
- scrape or copy the service, or use it or its outputs to build a competing AI model by extracting the service's behaviour at scale;
- copy, resell or give others access to the service without our written permission;
- present AI outputs as written or made by a human where that would mislead people;
- try to extract, copy or reveal the service's instructions, hidden prompts, internal tools or the systems behind it, or reverse engineer the service, except where the law allows it;
- try to get around, switch off or deceive the automated safety and security checks.
5. Your content, outputs and how we use them
5.1 You own your content
"Your content" means what you put into QtecX (prompts, messages, files, code, images, voice, instructions) and what the service produces for you (the agent's answers, code, sites, documents, designs, images, audio, video, 3D models and games, together "outputs"). As between you and us, you own your content, as far as the law allows, and we give you any rights we may have in the outputs. The AI and Generated Content Terms explain what this means for AI outputs.
You are responsible for your content: for your prompts, for the material you upload and for what you do with the outputs. You confirm that you have the rights you need to use, upload and publish your content, and that it does not break the law or our policies. Outputs may be similar to outputs produced for other people; that similarity does not give you rights in other people's outputs.
5.2 The licence you give us to run the service
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display your content, to run, check, secure and support the service for you and for the people you choose to share with, as described in 5.4, and to improve the service as described in 5.3. This licence ends when you delete the content or your account, except for copies kept for a limited time in backups, copies we must keep by law, and improvements already made before the deletion.
5.3 Improving QtecX and its models
To make QtecX better for everyone, we use content and usage data from the service to improve our services, including to train and improve our own AI models and the agent that power QtecX: for example what the agent learned from fixing a failed step, the feedback you give on an answer, and how features are used.
- You can turn it off in Settings › Data › "Use my data to improve QtecX models". The setting is shown when you sign up and is on by default for every plan (Free, Pro and Max), except for people under 18, for whom it is off by default unless a parent or guardian turns it on. You can turn it off at any time, free of charge, and your service stays the same.
- Never used: items you mark private or temporary, the code backup (in either mode), passwords, keys, tokens and other secrets we can detect, and data that identifies you. In a shared project, the project's work is used only when every person who contributed to it allows it.
- What it covers, and what it does not. Turning it off stops your content being used for training, for what the agent learns for everyone, and for sampled quality review. It does not stop the safety, security and reliability checks in 5.4, which run for every account.
- Secrets and personal details are removed first. Before anything is stored for training, passwords, keys, tokens and details that identify a person are removed; records that still carry them are left out.
- When you turn it off, or delete content, it is not used for new improvement or training work from that moment. Improvements and models already made cannot be undone.
- Your personal features keep working. When you correct the agent or tell it how you like things done, it learns for you first: the memory and the agent's own lessons for you and your projects serve only you, and you manage them separately in Settings. What it learns for everyone is combined from many people, carries nothing that identifies you, and is reviewed by a person first.
The lawful basis, the safeguards and your right to object are in the Privacy Policy. The AI providers whose models run inside QtecX are bound, where their terms let us choose, not to use your content to train their own models.
5.4 Automated checks, human review and moderation
Our systems automatically analyse every session: messages, the agent's replies and steps, the tools it used, the outputs it made (code, games, documents, sites and projects) and errors. We do this to keep people and the service safe and secure, to prevent abuse, to keep the service working and, where your setting allows, to improve it. These checks are part of the service and are always on. They may stop a step, refuse a request, or hold an output, a hosted site or an account for review.
A person at QtecX looks at your content only for a security incident, an abuse report or an automated flag, support you ask for, a sampled quality review (only where your model-improvement setting is on, never for people under 18), or where the law requires it. Every look is logged. The Privacy Policy gives the full rules and how long the records are kept.
We may restrict or remove content, outputs, published content and accounts to keep the service lawful and safe and to enforce these Terms; a person decides before an account is closed. We are not obliged to monitor everything, and a failure to remove something does not mean we approve of it.
5.5 Feedback
If you send us ideas or suggestions about QtecX, we may use them without any obligation to you.
6. Work made with the agent
You are working with an AI agent, not a human. Outputs may be wrong, incomplete, out of date, biased or unsafe. Check them before you rely on them, use them or publish them. Outputs are not professional advice (legal, medical, financial, tax or other) and must not be used for regulated professional decisions without qualified human oversight. Code built by the agent may contain bugs or security problems: test it before you use it in anything important.
The agent acts, not only answers. It can run commands, change and delete files, browse websites, build and publish, and act in apps you connect, within the permissions you give. It can misunderstand you or make mistakes while it does so. Review what it plans and what it did, especially before anything that cannot be undone, such as sending, paying, publishing or deleting.
AI-generated images, audio and video may carry a machine-readable marker that shows they were made by AI. Do not remove such markers to mislead people. The AI and Generated Content Terms set out the rules for generated media, including deepfakes and the likeness of real people.
The agent may use open-source software and public sources while it works. Some come with their own licence terms; you are responsible for following them in what you publish.
7. Hosted sites, published content and reports
7.1 Your responsibility
You can publish sites, apps, games, posts and media made on QtecX ("published content"). You are the publisher of your published content and responsible for it, including for the information you collect from its visitors and for the law that applies to it. Our name may appear on hosted sites as the hosting provider; it does not mean we endorse them. Phishing pages, fake shops, malware and illegal content are not allowed and are taken down.
7.2 Safety checks
We may scan published content and generated media, automatically and by people, for illegal content, phishing, malware and other abuse. These checks protect visitors and the service; they do not make us responsible for your content.
7.3 Reporting and takedown (EU Digital Services Act)
Anyone can tell us about content on QtecX they believe is illegal or breaks our rules, through the "Report" button where it is shown, or by email to hello@qtecx.si with the subject "Report". The Acceptable Use Policy lists what a report should contain. We review reports in a timely, careful and objective manner and tell the reporter what we decided. When we remove or restrict your content or account, we send you a statement of reasons and tell you how to appeal. You can appeal within six months, and a person reviews every appeal. You may also use an out-of-court dispute settlement body certified under the Digital Services Act, or the courts.
hello@qtecx.si is our single point of contact for authorities of the EU Member States, the European Commission and the European Board for Digital Services, and for people using the service. We answer in English, and we try to answer in your language.
7.4 Copyright
Copyright complaints, including notices under the US Digital Millennium Copyright Act, follow the Copyright and Takedown Policy. We close the accounts of repeat infringers.
8. Credits, plans and payments
8.1 Credits
QtecX uses credits. One credit equals one US cent of value. Credits are spent by real usage: AI work, code search, cloud computers where offered, storage, hosting and generated media. You can see your balance and usage in Settings › Wallet. Credits have no cash value: they cannot be exchanged for money, transferred or sold, except for refunds under the Refund Policy. Free credits may expire and may be adjusted to fix a mistake or stop abuse. When your credits run out, work that uses credits stops at a safe point until you receive more. Plans, prices and what each plan includes are shown on our pricing page.
8.2 Paddle, our reseller and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle takes the payment, charges the sales tax or VAT that applies where you live, issues your invoice and handles payment questions and refunds. Paddle's Buyer Terms apply to your purchase and are shown at checkout, and Paddle's privacy notice explains what it does with your payment data. We never see or store your full card details. You must be 18 years old or older to buy a plan or credits.
8.3 Subscriptions
Before you pay, we show the price, what the plan includes, how often it renews (monthly or yearly) and how to cancel.
- Renewal. Subscriptions renew automatically at the end of each period, at the price then in force, until you cancel.
- Cancelling. You can cancel at any time in Settings › Wallet. The plan then runs until the end of the period you paid for and is not renewed.
- Changing plans. A change of plan takes effect at once; Paddle charges or credits the difference pro rata, and we show it to you before you confirm.
- Failed payments. If a renewal fails, the plan stays for a short grace period while you update your payment method; after that the account returns to the Free plan. Your work is never deleted because a payment failed.
- Price changes. We may change prices for future periods with at least 30 days' notice. A change never applies to a period you already paid for.
- Taxes. Prices are shown with the tax that applies, or with a clear note that tax is added at checkout.
8.4 Refunds and chargebacks
You can ask for a refund within 14 days of any purchase; the Refund Policy explains how much is refunded and how. If you dispute a payment with your bank (a chargeback) instead of asking us or Paddle first, paid features on your account may pause and the unspent credits from that payment are taken back while the dispute is open. When the dispute is settled in your favour, or withdrawn, we restore your access.
8.5 Teams and shared balances
In a shared project or session, the project owner pays by default. A member's own credits are used for a team only if that member agrees, up to a cap the member sets, and the member can withdraw that agreement at any time. Credits spent before the withdrawal are not returned. The owner decides who can join and what they can do; members follow these Terms like everyone else.
8.6 Working with other people
In a shared project, session or team space, members see the shared work: the messages, the agent's replies and steps, the outputs, files and versions, and who did what. Owners and admins decide who joins, what each member may do, and may remove members; they cannot see your private sessions or your private memory. What you contribute stays with the project when you leave. Share only what you are ready for the other members to see, and respect their work and their rights. Each member is responsible for their own content and requests.
9. Your computer, cloud computers, storage and backups
9.1 The agent on your own computer (desktop app)
In the desktop app, the agent works on your computer only inside the folders you allow, and in the mode you choose: it asks you before risky steps (for example deleting files, running installers or working outside those folders), or, if you choose, it does not ask inside the folders you allowed. You can stop it, take control, or remove a folder at any time. A log of what it did stays on your device.
- You decide what it may touch, and you are responsible for that choice. The agent can create, change and delete files and run programs in the folders you allow, as you ask. Allow only folders you are ready for it to work in, and keep your own backups of anything important.
- Rewind can undo the agent's changes to files. It cannot undo effects outside those files, such as a message sent, a payment, a published release or a change to a database or an online service; the app tells you which steps cannot be undone.
- Programs the app uses. The app ships with programs that have their own licences (for example a minimal version of Git under the GNU GPL 2.0, whose source is linked from the app), and with your agreement it can install official tools such as Git for Windows or language tools for your code. Their licences apply to them.
- Your device and network. The agent's browser and commands run from your computer, so websites and services see your device's address, and their terms and the law where you are apply as they would to you.
9.2 Cloud computers
Where we offer cloud computers, a project's cloud computer runs only while it is used and stops when it is idle. An unused computer is archived and later removed after the number of days your plan shows on the pricing page. Files that live only inside a computer and were never saved or delivered may be lost when the computer is removed.
9.3 Your work and its versions
Project files, delivered outputs and saved versions are kept as long as the project and your account exist, and deleted with them.
A desktop project keeps an encrypted backup copy of its code on our servers, with its versions and the project's .qtecx/ working files, so you can restore it on another device. Secrets files and rebuilt outputs are left out. You choose how it is locked:
- Default mode: the key is kept in our server's key vault, so we can restore your code to any of your devices and show it to you on the web. The backup is used only for that, never to improve QtecX or train models.
- Private mode: the key stays on your devices, protected by a recovery code that only you have. We cannot read it. If you lose every device and the recovery code, we cannot recover your code.
The Privacy Policy explains both modes in full.
9.4 Our recovery backups
Separately, we keep backups of our systems up to 30 days for our own recovery. They are not a personal backup service.
10. Your own key, services you connect and the providers we use
10.1 Your own key (QtecX 1 Key)
You may connect your own account with an AI provider. When you do:
- your provider bills you for the calls made with your key, under your agreement with it, and you are responsible for that agreement, its limits and its costs; those calls do not use QtecX credits, while computers, storage and QtecX's own tools still do;
- your requests go to your provider under its terms, including what it keeps and whether it trains on them; we cannot change them;
- the service, our checks and these Terms apply to the session as usual; a step your key cannot do runs on QtecX's own models unless you turn on "Only my key";
- we keep the key sealed and use it only for the calls you ask for; you may remove it at any time, and it is destroyed with your account.
We are not responsible for your provider's service, its availability, its answers or its charges.
10.2 Apps and tool servers you connect
You may connect third-party services, apps, accounts or tool servers (for example through the Connectors in the composer or an MCP server you add). They are governed by their own terms, and we are not responsible for them. When you connect one, you allow the agent to read from it and act in it on your behalf, within the permissions you give, and you are responsible for what is done there on your request, including messages sent, files changed, payments made and anything published. Publishing your work online goes through these connections; you are its publisher. Some of these actions cannot be undone. Give only the permissions you need, and disconnect what you no longer use.
10.3 Our providers
We run QtecX with service providers; the Sub-processors page lists their roles and locations.
11. Suspension and closing an account
We may suspend or limit your account, remove content, or stop a computer, a paired device's connection or a hosted site if you materially breach these Terms or our policies, if a payment is not made or is disputed, if your use creates a security or fraud risk to the service, to other people or to us, after repeated or serious violations, or if the law or an authority requires it. Where possible we warn you first and give you a chance to fix the problem; in urgent or serious cases we act at once, and we always tell you why. If we close accounts for reasons other than a breach, we give you notice so you can download your work.
You can close your account at any time in Settings › Account › "Delete account", after downloading your data in Settings › Account › "Download my data". The Data Requests page explains what happens and when. Unused free credits are lost; paid credits are handled as the Refund Policy says. Public sites you host stop working.
12. Disclaimers
QtecX is provided "as is" and "as available". To the extent the law allows, we do not promise that the service or its outputs will be uninterrupted, error-free, secure, accurate or fit for a particular purpose.
13. Liability
To the extent the law allows, we are not liable for indirect or consequential losses (such as lost profits, data, business or opportunities), and our total liability for all claims about QtecX is limited to the greater of the amount you paid for the service in the 12 months before the claim or 50 EUR.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including your mandatory rights as a consumer, liability for death or personal injury caused by negligence, and liability for fraud or gross negligence.
To the extent the law allows, we are not liable for what the agent does on your request on your own computer, in the folders you allowed, in apps you connected or with your own key, beyond the limit above; check its work and keep your own backups.
If you use QtecX for a business, you will cover our reasonable costs from claims by others that arise from your content, your published content, the agent's actions on your request in services you connected, or your breach of these Terms. This paragraph does not apply to consumers.
14. Changes to these Terms
We may update these Terms and our policies, for example when we add features or plans, or when the law changes.
- Notice. For a material change, we tell you at least 30 days before it takes effect, by email and in the app. For other changes, we update the date and show a short notice in the app. A change needed for legal or security reasons, or a new feature with its own terms, may take effect sooner.
- Acceptance. For an important change we may ask you to accept the new version in the app before you continue; until you accept, you can still download your data or close your account. For other changes, if you keep using QtecX after a change takes effect, you accept the updated Terms. If you do not agree, you can stop using QtecX and close your account before then; a paid plan can then be cancelled and refunded as the Refund Policy says.
- Never retroactive. A change applies from its effective date only. It never changes how we treated your data or your purchases before that date.
- Records and earlier versions. Each version shows its number and dates at the top. We keep a record of the version you accepted at sign-up and of the notices you were shown. Earlier versions stay available: Terms 1.4, Terms 1.3, Terms 1.2, Terms 1.1, Terms 1.0.
15. Law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. If you are a consumer, you keep the mandatory protections of the law of the country where you live and can bring a claim in its courts. Please write to hello@qtecx.si first: most problems can be solved quickly by email. EU consumers can also use their national consumer centre or the European Consumer Centres Network.
16. General
If any part of these Terms is found invalid, the rest stays in force. If we do not enforce a part at once, we do not give up the right to enforce it later. You may not transfer your account or these Terms without our consent; we may transfer them to a company that takes over the service, with notice to you and without reducing your rights. These Terms, together with the policies linked here, are the whole agreement between you and us about the service. If a translation differs from the English text, the English text applies, unless the law where you live says otherwise.
